1. Acceptance of Terms

By creating an account, accessing, or using RideCraftIQ (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.

RideCraftIQ is an online platform designed to assist motorcycle riders in tracking their progress, planning training sessions, and accessing educational resources. The Platform provides tools for:

  • Planning track day training sessions
  • Accessing curated educational content
  • Managing gear and equipment

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

4. User Responsibilities

4.1 Safe Riding

IMPORTANT: RideCraftIQ is an informational and tracking tool only. The Platform does not provide professional instruction, and use of the Platform does not substitute for proper training from qualified instructors.

You acknowledge and agree that:

  • Motorcycle riding is inherently dangerous
  • You are solely responsible for your own safety
  • You will always ride within your skill level and legal limits
  • You will use appropriate safety gear at all times
  • You will follow all applicable laws and track regulations

4.2 Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Share your account credentials with others
  • Attempt to gain unauthorized access to the Platform
  • Interfere with the Platform's operation
  • Submit false or misleading information
  • Use the Platform to harass or harm others

5. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are owned by RideCraftIQ and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the Platform will be uninterrupted, error-free, or secure.

8. Limitation of Liability

8.1 No Liability for Riding Activities

RideCraftIQ assumes no liability whatsoever for any injuries, damages, or losses that occur during motorcycle riding activities, whether on the street, track, or elsewhere. Your use of any information from the Platform is entirely at your own risk.

8.2 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDECRAFTIQ AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless RideCraftIQ and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Platform

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Effective Date" at the top of this document
  • Notify you via the Platform or email
  • Require you to accept the updated Terms before continuing to use the Platform

Your continued use of the Platform after accepting updated Terms constitutes your agreement to the changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RideCraftIQ operates, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RideCraftIQ regarding your use of the Platform.
